HelenJudith Terms and Conditions

HelenJudith is pleased to accept orders subject to the terms and conditions set out below. These terms and conditions describe the basis for the purchase by you and sale by us of the products and services on the HELENJUDITH.COM (or HELENJUDITH.CO.UK) website (the "Website"). We recommend that you read them carefully before placing an order. Your use of the Website and purchase of the products (or services) on it means that you agree to these terms and conditions. No variation of these terms and conditions shall be binding unless agreed in writing and signed by an authorised representative of HelenJudith.

1. Definitions

   In these terms and conditions

   - "you" and "your" as appropriate refer to the buyer;

   - "us", "our" and "we" refer to the seller, HelenJudith;

   - our address is PO Box 52794 London EC4P 4XZ;

   - our VAT registration number is GB 835 8594 81;

   - "Days" refers to working days, being Monday to Friday inclusive, excluding bank holidays, unless otherwise stated; and

   - "Products" means any product or service sold by HelenJudith to a customer.

2. Orders / Availability of Products
   1. Receipt of your order does not guarantee that we can supply the selected Products to you. All of the Products are subject to availability and we reserve the right to withdraw Products from sale or to restrict in any way or refuse the Products we supply.
   2. We will confirm receipt and acceptance of your order.
   3. We will only charge you for the Products we are able to deliver to you and will refund any payment made relating to Products we are unable to supply to the extent that we are unable to deliver the Products to you as ordered.
3. Payment
   1. Payment for the Products and any related delivery costs will be due before the Products are despatched.
   2. All prices shown on the Website are stated in British pounds sterling and include VAT at the appropriate rate. Orders outside the EU will be exempt from VAT. Prices do not include charges for delivery.
   3. We always try to make sure that the prices on the Website are accurate but occasionally errors or price changes may occur. If there is any change in the price of any Products in your order we will notify you as soon as possible using the contact details that you provided. We will provide you with the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If an order is subsequently cancelled, any payment made for the Products will be refunded in full.
   4. We reserve the right at any time to revise our prices. We will take all reasonable steps to notify you of any revision of prices before processing your order. Any customs or duties charged at the country of destination will be the responsibility of the customer.
4. Delivery
   1. All Products will be packaged and despatched via Royal Mail standard parcel delivery (unless otherwise agreed).
   2. Unless we specify otherwise, delivery dates will be as set out in the Website. However, all delivery dates are given only for general guidance and we will not be held liable in any way for late delivery of Products.
   3. Delivery charges will be additional as set out in the Website (unless otherwise agreed).
   4. Please contact us directly to discuss any particular delivery requests.
5. Returns

   We hope that you will be completely satisfied with your HelenJudith Products. If you do wish to return any Product please return it to us within 28 days of receipt. We will be happy to exchange the Product, subject to availability, or issue a refund in full provided the Product has not been damaged, washed or soiled in any way. You will be responsible for the direct costs of returning the Product.

6. Title

   Any Products supplied remain the property of HelenJudith until such time as the price has been paid in full.

7. Intellectual property

   The intellectual property in the material contained in the Website, together with website design, text and images belong to HelenJudith or the providers of such information. This applies also to the design and patterns of the Products. Some product and company names mentioned on the Website may be the trademarks or registered trademarks of their respective owners.

8. Complaint

9. Liability
   1. HelenJudith's total liability in contract, tort (including negligence or breach of statutory duty) or otherwise, arising in relation to any order placed or Products supplied shall be limited to the price paid for the Products.
   2. Nothing in these terms and conditions excludes or limits the liability of HelenJudith for death or personal injury caused by HelenJudith's negligence.
   3. HelenJudith shall not be liable to you in contract, tort (including negligence or breach of statutory duty) or otherwise for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with our supply of Products to you.
10. Force Majeure

    HelenJudith will not be liable for any failure to perform any obligation in whole or in part in connection with an order due to an event beyond our reasonable control.

11. Jurisdiction

    The Law of England shall apply to these terms and conditions and the English Courts shall have exclusive jurisdiction.

12. Statutory Rights

    These terms and conditions are additional to and do not affect your statutory rights.
